1. Acceptance of these terms

These terms govern your use of the corporate website at quantumcx.net, operated by QUANTUMCX PRIVATE LIMITED. By using this website you accept them. If you do not accept them, please do not use the website.

These terms apply to the website only. They do not apply to the PSEO Engine application, which is governed by its own terms published on its own deployment, and they do not govern any client engagement.

2. Permitted use of the website

You may read, browse and print material from this website for your own information, and you may share links to it. You must not:

• Copy, republish or redistribute substantial parts of the website content as your own.
• Use the website in any way that breaches applicable law, or that infringes the rights of anyone else.
• Attempt to gain unauthorised access to the website, its underlying infrastructure or any connected system.
• Introduce malicious code, or interfere with the availability or integrity of the website.
• Submit information through the enquiry form that is false, misleading, or that you are not entitled to disclose.
• Use automated systems to submit the enquiry form, or otherwise impose an unreasonable load on our infrastructure.

We may restrict or block access where we reasonably believe these terms have been breached.

3. Information, not advice

The content on this website is provided for general information about our company and our capabilities. It is not professional, legal, financial, tax or technical advice, and it should not be relied upon as a substitute for advice specific to your circumstances.

Any decision you take on the basis of material published here is your own responsibility.

4. Products and services

Descriptions of products and services on this website are indicative. They do not constitute an offer capable of acceptance, and they do not create a contract.

Any engagement for custom software development, automation, AI implementation or other professional services is governed exclusively by a separate written agreement between you and Quantum CX, which will set out scope, deliverables, assumptions, fees, acceptance criteria, intellectual property ownership, confidentiality and liability terms. Where that agreement conflicts with anything on this website, the agreement prevails.

Use of the PSEO Engine product is governed by separate subscription terms and a separate privacy policy published on the product's own website.

5. Forward-looking statements and development status

This website describes products and internal systems at different stages of development, and labels them accordingly as Live, In development, Exploring or Planned. Those labels are the authoritative statement of status.

Descriptions of systems that are in development, exploring or planned — including JARVIS and the AI workforce operating model — describe intentions and design direction. They are not commitments, not promises of delivery, and not a representation that any such system is operational. We may change, delay, reprioritise or discontinue any of them without notice.

• We make no guarantee of search rankings, traffic, revenue or any other commercial outcome from any product or service.
• We make no guarantee of accuracy, completeness or fitness for purpose from any AI or automation system, which are non-deterministic by nature.
• We make no claim of zero-error or fully autonomous operation.
• We do not claim certifications, accreditations, offices or capabilities we do not hold. Where a capability depends on a separate authorisation or scope, that is stated on this website.

6. Intellectual property

The content, design, source code, brand marks and documentation on this website are owned by or licensed to Quantum CX and are protected by applicable copyright, trade mark and other intellectual property laws. Nothing in these terms grants you a licence to use our name, logo or brand marks.

Ownership of intellectual property created under a client engagement is determined by the written agreement governing that engagement, not by this website. We do not claim ownership of your pre-existing materials, and you do not acquire rights in our pre-existing components, tools or methods merely by engaging us.

This website may reference third-party open-source projects. Those remain subject to their own licences.

7. Third-party links and services

This website links to external sites and services, including the PSEO Engine application and the websites of software providers. We do not control them and are not responsible for their content, availability, security or privacy practices. Following an external link is at your own risk and subject to that site's own terms.

8. Availability and warranties

This website is provided on an "as available" basis. We aim to keep it accurate, secure and available, but we do not warrant uninterrupted or error-free operation, and we may suspend, withdraw or modify any part of it at any time.

To the fullest extent permitted by applicable law, we exclude all warranties, conditions and representations not expressly stated in these terms, whether express or implied.

9. Limitation of liability

To the fullest extent permitted by applicable law, Quantum CX will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profit, revenue, business, goodwill, anticipated savings or data, arising out of or in connection with your use of this website, whether in contract, tort (including negligence) or otherwise.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or fraudulent misrepresentation, or for death or personal injury caused by negligence. Liability arising under a client engagement is governed by the agreement for that engagement.

Independently of any engagement, our total aggregate liability relating to your use of this website is limited to the greater of the amount you have paid us in the twelve months preceding the claim, or INR 10,000.

10. Your responsibility

You agree to indemnify Quantum CX against claims, losses and reasonable costs arising from your breach of these terms, your misuse of the website, or your submission of information through the enquiry form that you did not have the right to disclose.

11. Privacy

Our handling of personal data collected through this website is described in our Privacy Policy, which forms part of these terms. In summary: we collect what you submit through the enquiry form, any analytics enabled are cookieless and aggregate, we do not set tracking cookies, and we do not sell your data.

12. Governing law and jurisdiction

These terms and any dispute arising out of or in connection with them, including non-contractual disputes, are governed by the laws of India.

Subject to any mandatory provisions of law to the contrary, the courts at West Bengal, India have exclusive jurisdiction over any such dispute.

Nothing in this clause prevents either party from seeking urgent injunctive relief from a court of competent jurisdiction.

13. Changes to these terms

We may update these terms from time to time. The version published on this website at the time you use it is the version that applies, and the date at the top of this page records when it was last revised. Continued use of the website after a change constitutes acceptance of the revised terms.
